These Terms and Conditions (“Terms”) are an agreement between you and The UpSurge Agency LTD (“The UpSurge Agency”, “we”, “us” or “our”) covering your use of theupsurgeagency.com and our text messaging program. By using the site, submitting a form, booking a consultation or opting in to text messages, you agree to these Terms and to our Privacy Policy.
Program. The UpSurge Agency conversational messaging program lets our team text with you about your inquiry and consultations.
Opting in. Our website form has two separate, unchecked consent boxes: one for informational and conversational texts about your inquiry and appointments, and an optional, independent one for marketing texts with offers and updates. You may also opt in to informational texts about a consultation by providing your mobile number when booking it with us. By opting in you confirm that you are the owner or authorized user of the mobile number provided and that you are at least 18 years old. Consent to receive text messages is not a condition of purchasing any goods or services.
Message types and frequency. Informational messages are sent by a member of our team and include replies to your inquiry, confirmations and reminders for consultations you have booked, rescheduling, and follow-up on your inquiry. If you also opted in to marketing texts, you may occasionally receive offers and updates from The UpSurge Agency. Message frequency varies.
Cost. Message and data rates may apply. Contact your wireless carrier for details about your plan.
Opting out. You can cancel at any time by replying STOP to any message or by texting STOP to (559) 249-1157. After you send STOP we will send you one final message confirming that you have been unsubscribed, and you will receive no further messages from us. To rejoin, reply START or opt in again through our website.
Help. Reply HELP to any message, or email theupsurgellc@gmail.com, for assistance.
Carriers. Messages are available on major carriers in the United States and Canada, including AT&T, T-Mobile, Verizon, US Cellular, Rogers, Bell and Telus. Carriers are not liable for delayed or undelivered messages.
Your number. If you change or deactivate your mobile number, please let us know so we can update our records.
Privacy. How we handle your phone number and consent is described in our Privacy Policy. We do not sell or share your SMS opt-in data or personal information with third parties for marketing purposes.
You may use the site for lawful purposes only. You agree not to interfere with its operation, attempt to gain unauthorized access, scrape or copy its content in bulk, or use it to send unsolicited communications.
Submitting a quote request or booking a consultation is a request for information, not a contract for services. Any services we provide are governed by a separate written proposal or agreement, which sets out the scope, fees, timelines and deliverables. Information on the site, including pricing examples, is for general guidance and may change.
The content of this site, including text, design, graphics, logos and portfolio work, belongs to The UpSurge Agency LTD or our clients and is protected by copyright and trademark law. You may not reproduce or use it without our written permission.
The site and its content are provided “as is” without warranties of any kind, express or implied. We do not guarantee that the site will be uninterrupted or error-free.
To the fullest extent permitted by law, The UpSurge Agency LTD will not be liable for any indirect, incidental, special or consequential damages arising from your use of the site or our messaging program.
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable there. Any dispute will be resolved in the courts of British Columbia.
We may update these Terms from time to time. The effective date at the top shows when they were last revised. Continued use of the site or the messaging program after a change means you accept the revised Terms.
