The UpSurge Agency LTD (“The UpSurge Agency”, “we”, “us” or “our”) operates theupsurgeagency.com and provides web design, content and marketing services from Kelowna, British Columbia, Canada. This Privacy Policy explains what information we collect, how we use it, who we share it with, and the choices you have. By using our website, submitting a form, booking a consultation or opting in to text messages, you agree to this policy.
Information you give us. When you request a quote, book a call, or contact us, we collect what you enter: your name, email address, phone number, business name and type, current website, budget and timeline, and anything you write in a message. Consultations booked through our Calendly scheduling page collect your name, email, phone number and the answers you provide when booking.
Information collected automatically. When you browse the site we and our analytics providers collect the pages you visit, the site that referred you, your approximate location, and your device, browser and IP address, using cookies and similar technologies. We use Google Analytics, Microsoft Clarity (which may record how you interact with pages, such as clicks and scrolling) and the Meta Pixel.
Messaging information. If you opt in to text messages we keep your mobile number, a record of your consent (the date, time and form or booking it came from), and the text conversation between you and our team.
How you opt in. Our website form has two separate, unchecked boxes. The first lets us send informational and conversational texts about your inquiry and appointments. The second, which is optional and independent of the first, lets us send occasional marketing texts with offers and updates. You may also receive informational texts about a consultation when you provide your mobile number while booking it with us. Consent is not a condition of purchasing any goods or services.
What you will receive. If you check the first box: replies to your questions, confirmations and reminders for the consultation you booked, rescheduling, and follow-up on your inquiry. If you also check the marketing box: occasional offers and updates from The UpSurge Agency. Message frequency varies. Message and data rates may apply.
How to opt out. Reply STOP to any message at any time and you will be unsubscribed; you will receive one final message confirming this. For help, reply HELP or email theupsurgellc@gmail.com.
No sale or sharing of opt-in data. We do not sell or share your SMS opt-in data or personal information with third parties for marketing purposes. Your mobile phone number and your text messaging consent will not be shared with or sold to any third party or affiliate for their marketing or promotional purposes. We use a messaging platform provider (Twilio) solely to deliver our messages to you on our behalf.

Records of text messaging consent are kept for as long as needed to demonstrate that consent was given. Information that is no longer needed is deleted or anonymized.
We use reasonable administrative, technical and physical safeguards to protect personal information, including encrypted connections and restricted access. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.
You may ask to access, correct or delete the personal information we hold about you, or withdraw your consent, by emailing theupsurgellc@gmail.com. You can stop text messages at any time by replying STOP, and stop marketing emails using the unsubscribe link in any email. We handle personal information in accordance with Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA) and British Columbia’s Personal Information Protection Act. If you are not satisfied with our response you may contact the Office of the Privacy Commissioner of Canada.
Our website and services are intended for businesses and adults. We do not knowingly collect personal information from anyone under 18.
